Filing a complaint

Colorado health officials on Monday issued the largest-ever penalty imposed by the state's radiation program against a company with links to a similar business that operated on Hilton Head Island, as well as members of the family that operate the companies.

Colorado's X-ray Certification Unit ordered Heart Check America to pay a $3.2 million penalty for conducting preventive CT imaging scans on patients without an order form a Colorado-licensed doctor, as well as other violations.

The company closed its Denver office in May after state inspectors confirmed the violations.

Heart Check America-Denver owner Sheila Haddad also owns Cancer Check America, which quit operating on Hilton Head in May amid scrutiny and questions about its link to Heart Check America.

Her son, David Haddad, and daughter-in-law, Lisa Haddad, managed both businesses, offering free lung or heart CT scans on the island in the hope people would sign up for a package of examinations.

In an email response to several questions from a reporter, Lisa Haddad wrote: "Heart Check America has a legal team that is responding to the Compliance Order."

Lisa Haddad in June said Cancer Check America plans to reopen in the Hilton Head area "in 2012 with our mobile scanner or at a permanent location."

It's unclear whether the company would reopen in the area, given Monday's news.

"Heart Check America was exposing approximately 150 customers per week to potentially unnecessary radiation doses without a doctor's involvement," said Brian Vamvakias, Colorado X-ray certification unit leader for the Colorado Department of Public Health and Environment, in a news release. "These exams can provide important diagnostic information to a medical professional and are necessary in many instances to determine the presence or extent of a disease. But patients should submit to X-ray and CT exams on the recommendation of their doctor, not the advice of a salesman.

LLR is (or in this case, was) getting paid NOT to enforce a bogus requirement. A spokeswoman for SC LLR did not immediately respond to our request for comment regarding the list. Neither did SC Gov. Nikki Haley's office – which oversees the agency.




South Carolina updates Labor Law Poster to require E-Verify ...

South Carolina announced an update to its Labor Law Poster, changing its Immigrant Worker section of the LLR S.C. Labor Law Abstract to require all employers verify employee’s legal status using E-Verify by January 1, 2012.

Amendments to the “South Carolina Illegal Immigration and Reform Act” were signed into law by Governor Nikki Haley on June 27, 2011. The amended law requires all employers to enroll in the U.S. Department of Homeland Security’s E-Verify system beginning January 1, 2012 and to verify the legal status of all new employees through E-Verify within three business days of hiring. Failure to enroll in and use E-Verify to verify new hires will result in probation for the employer or suspension/revocation of the employer’s business licenses.

This change has caused an LLR S.C. Labor Law Abstract in July 2011 that eliminates other ways employers could verify the legal status of an employee, such as possession of a state driver’s license.

Check to see that your Labor Law Poster carries the new requirement in the bottom section of the Labor Law Abstract under the heading Immigrant Worker. The previous revision was in July, 2010.
